$10,000,000.00+ Fraud/Breach of Contract

This settlement was achieved on behalf of approximately 360 airline pilots who alleged they had been fraudulently induced into continuing to fly for commercial airlines who were soon to be put out of business by a major national commercial airline. The settlement was reached after three days of protracted negotiations. The key to settling the claims was a favorable jury trial verdict received by one of our clients years earlier in the amount of $1.75 million, including $1,000,000 in punitive damages (see below).

$5,073,126.00 Wrongful Death/Product Liability/Asbestos

This jury verdict was obtained in Marshall County, Kentucky on behalf of the estate of a union pipefitter who died from asbestos-related lung cancer. After settling with numerous other defendants, we proceeded to trial with our client against the two remaining defendants. In addition to awarding the Plaintiffs estate medical and funeral expenses, the jury awarded the estate $5,000,000.00 for the pain and suffering the plaintiff experienced from the time of his diagnosis to the date of his death.

$3,200,000.00 Wrongful Death/Product Liability/Asbestos

This Campbell County, Kentucky mesothelioma cancer asbestos case was settled after the first day of trial. Eight different defendants each contributed significant amounts of money towards the settlement in order to avoid a potential multi-million dollar jury trial verdict against them. The deceased plaintiff was a career auto mechanic and local politician survived by his long-time wife and disabled son. He contracted mesothelioma cancer from his occupational exposure to asbestos-containing automobile products, including brakes.

$2,314,749.00 Wrongful Death/ Product Liability/ Asbestos/ Punitive Damages

The trial judge in the Marshall County, Kentucky case discussed above ordered a new trial because he ruled that the jury in that case should have assigned some responsibility to the other defendants with whom plaintiff had settled prior to trial. Following the conclusion of this second trial, the jury again found in favor of the plaintiff and against the same two defendants. In addition, to compensatory damages, this second jury also assessed $700,000 in punitive damages against defendants.

$2,064,375.00 Wrongful Death/Product Liability/Asbestos

This verdict was rendered by a jury in federal court against an asbestos gasket manufacturer in favor of the estate of a deceased union pipefitter who died of mesothelioma cancer. The unanimous verdict was rendered after approximately one and a half weeks of trial.

$1,750,000.00 Fraud/Breach of Contract/Punitive Damages

This Jefferson County (Louisville) Kentucky jury verdict included $1,000,000 in punitive damages. The plaintiff, one of approximately 360 airline pilots who joined our lawsuit, alleged he had been fraudulently induced to remain employed with his soon-to-be defunct commercial airline upon a promise that he would be hired by a new commercial airline in the future. After a three week jury trial, the jury found that the new airline had defrauded our client by essentially lying to him and awarded him $750,000 in past and future lost wages, in addition to $1,000,000 in punitive damages.

$1,521,000.00 Wrongful Death/ Product Liability/ Asbestos/ Punitive Damages

This verdict was rendered by a Jefferson County (Louisville) Kentucky jury in favor of the estate of a union pipefitter who died of asbestos-induced lung cancer. The verdict was rendered against two defendants, an asbestos gasket manufacturer and a Louisville chemical plant owner who had extensive asbestos products throughout its plant. The verdict included a punitive damage award of $400,000.

$1,500,000.00 Premises Liability/Brain Injury to Minor

Our client was an eleven year-old boy who sustained a brain injury when he unsuspectingly rode his bicycle into the large bowl at the Louisville Extreme Park. The City of Louisville maintained that users of the park, including plaintiff, had been adequately warned of the dangers involved and that they were to use the park at their own risk. However, after proving that the minor plaintiff was just one of several individuals who had seriously injured themselves in a similar way and the City did nothing to prevent future similar injuries from occurring, the Kentucky Court of Appeals unanimously held that the City could be held liable for negligently failing to either make the Extreme Park safe and/or failing to adequately warn users of the hidden dangers in the Park. Shortly after this Kentucky Court of Appeals ruling, the City settled this case.

$1,395,000.00 Wrongful Death/Product Liability/Asbestos

This mesothelioma cancer asbestos case in Campbell County, Kentucky against two defendants settled after less than one year of litigation. The deceased plaintiff contracted mesothelioma cancer by removing and installing asbestos-containing brakes at his home for family and friends. He was survived by his long-time wife and three children.

$865,000.00 Federal Polygraph Protection Net/Punitive Damages

This Jefferson County (Louisville) Kentucky jury verdict was awarded to five former employees of the River City Correctional Center that had been terminated in violation of the Federal Polygraph Protection Act. Each of the plaintiffs were forced to take a polygraph by the Correctional Center management after inmates had accused them of various improprieties. The verdict included approximately $500,000 in punitive damages. The defendant Correctional Center settled the case soon after the judgment was entered against it.

$675,000.00 Wrongful Death/Product Liability/Asbestos

The plaintiff in this Kenton County (Covington) Kentucky case died from asbestos-induced lung cancer after working in and around diesel locomotives much of his adult life. The single defendant in this case settled approximately one week before it was scheduled to go to trial.

$660,000.00 Product Liability/Benzene

The plaintiff in this case contracted a pre-leukemia blood disease as a result of his occupational exposure to benzene in a cleaning solvent manufactured by the defendant. The defendant vigorously defended this federal case in Frankfort, Kentucky for approximately two and a half years. After the federal judge made favorable rulings in favor of the plaintiff and ordered the case to be resolved by a jury, the defendant promptly settled the case.

$540,000.00 Motor Vehicle Accident/Negligence/Personal Injury

Our client was involved in a motor vehicle accident that aggravated his pre-existing lower back condition. Eventually the client, a civil engineer, underwent surgery to install instrumentation in his lower back. Although the defendant claimed that the plaintiffs back condition was pre-existing and that the motor vehicle accident contributed very little to the need for surgery, we nevertheless were able to settle this case for a very substantial sum.

$520,000.00 Breach of Contract

This Jefferson County (Louisville) Kentucky breach of contract verdict was obtained on behalf of a local contractor that was hired by a national out-of-state contractor to perform work during the expansion of the Louisville airport. The national contractor admitted to directing our client to perform additional work after the project started but contended that it did not have to pay for this additional work because the airport owner refused to pay the national contractor for the work. The jury disagreed and rendered a verdict for our client for the entire amount sought. The case settled shortly after entry of judgment.

$475,000.00 Medical Malpractice

This medical malpractice case settled within nine months of our firms involvement in the case. The case had been pending for approximately two years prior to our involvement. The case involved the negligent injection of the wrong medication into our clients arm, which resulted in chronic pain and swelling that had persisted for close to three years. Despite the defendants contention that we could not prove how the injection of the wrong medication had caused the pain and swelling, the defendant nevertheless settled this case after our firm assumed representation of the client.

$475,000.00 Lender Liability/Breach of Contract

In this lender liability case filed against a regional bank, our client corporation alleged that the bank wrongfully denied giving it a construction loan after promising to do so at the time it gave the client a land acquisition loan. After investing a considerable amount of its own money to partially construct the project, the client was unable to complete the project without the construction loan. Our investigation revealed that the defendant bank failed to make the construction loan because it had made a corporate decision to stop making commercial loans as a result of the banking crisis. In order to avoid a potentially much larger jury verdict, the defendant bank settled this case in its infancy.

$475,000.00 Nursing Home Negligence

Our firm represented the children of an elderly woman who died in a hospital due to aspiration pneumonia. We brought suit against the nursing home she had been living in and through discovery we were able to determine that the nursing home failed to follow the necessary procedures to ensure that residents who had difficulty chewing and swallowing food were properly monitored when eating. Despite our clients deceased mother having numerous other medical problems and her advanced age, we were able to settle this case for a very significant amount.

$470,000.00 Motorcycle Accident/Negligence/Personal Injury

This tragic case involved a young man who drove his motorcycle at an extremely high rate of speed after consuming large amounts of alcohol. When he attempted to pass a tractor trailer truck on the right in the emergency lane, the tractor trailer truck swerved, striking our clients handlebar, causing him to lose control of his motorcycle and propelling him into the air. He sustained a spinal cord injury leaving him wheelchair bound. Numerous law firms rejected this case. We accepted representation and were able to secure this substantial settlement after locating witnesses who were prepared to testify that it appeared the tractor trailer truck driver intentionally swerved to block our client from passing him.

$350,000.00 Motor Vehicle Accident/Personal Injury

Our client was involved in a motor vehicle accident in Cherokee Park. Despite the fact that he had prior back surgery, we were able to settle this case for a very significant sum after our clients treating physician advised he would need another surgery with instrumentation in the future.

$275,000.00 Medical Malpractice/Injury to Minor

In this Nashville, Tennessee medical malpractice case, our firm represented the parents of a small child who suffered profound hearing loss in both of her ears as a result of being administered an excessive amount of antibiotics while in the neonatal ICU. The antibiotics were necessitated as a result of the newborn child contracting MRSA from a nurse failed to follow numerous infectious disease control procedures. Our firms ability to locate and retain a nationally-renown expert on hospital infectious control policies and procedures was a key to successfully resolving this case before filing a lawsuit.

We represented a local demolition contractor who sued the City of Louisville for breach of contract arising out of the Citys failure to award dilapidated building demolition contracts. The City refused to settle the case. A Jefferson County (Louisville) Kentucky jury found in favor of our client and awarded the entire amount requested. The case settled shortly thereafter.

$165,000.00 Insurance Bad Faith/Punitive Damages

This insurance bad faith case started out as a simple automobile property damage claim. Our client attempted to get the responsible driver to pay her $1,500 property damage claim following a motor vehicle accident. The at-fault drivers insurance company refused to pay the claim because the at-fault driver told it not to as he disputed the amount of the damage. We brought suit against the insurance company for bad faith failure to pay this property damage claim. The jury awarded our client $150,000 in punitive damages against the insurance company.
